BREAKING: Appeal Court Gives Fresh Order On 27 Pro-Wike Lawmakers’ Case
During a virtual hearing via Zoom on Friday, the Court of Appeal in Port Harcourt ruled on two motions filed by Rt. Hon. Martins Amaewhule and other defected lawmakers.
They were challenging the Rivers State High Court’s injunction that barred them from functioning as lawmakers.
In its decision on the first motion, the Court granted the appellants’ requests to compile and transmit the Records of Appeal, recognized their Brief of Argument as filed, expedited the hearing, and stayed further proceedings at the High Court.
However, the Court of Appeal denied the request for a stay of execution and the nullification of the lower court’s interim order. It stated that granting such a request would effectively decide the appeal prematurely. The Court ordered that the current status quo be maintained until the appeal is heard.
Regarding the second motion, which sought to set aside the lower court’s interlocutory injunction, the Court of Appeal also denied this request and reiterated that the existing status quo should remain.
The respondents were instructed to submit their briefs within 72 hours of being served. The hearing of the appeal was adjourned to June 20, 2024.
